How Can Brehon Law Solve Today’s Problems? Irish Libertarian Perspective with X-Space host DáireBTC

Brehon Law, Ireland’s ancient Celtic legal system that endured for over a millennium until the 17th century, emphasised restorative justice through compensation rather than state punishment, with decentralised judges (Brehons) and no centralised enforcement—ideas that resonate with libertarian principles of voluntary markets and minimal government intervention.

From a modern libertarian viewpoint, reviving elements like competing arbitrators and folklore-based precedents could address contemporary issues such as over-policing, bureaucratic overreach, and economic centralisation, potentially integrating with decentralised technologies like Bitcoin for transparent, peer-to-peer resolutions.

This ancient system operated in a largely stateless society, where professional jurists trained extensively to interpret laws based on community harmony, financial restitution, and rehabilitation, avoiding the brute force of modern punitive systems and instead focusing on repairing social bonds to keep individuals as productive members of society.

In today’s context, libertarians see parallels in how Brehon Law’s emphasis on individual rights—such as women’s ability to own property, divorce, and participate in legal proceedings—could inspire reforms to reduce state monopolies on justice, promote voluntary arbitration markets, and even incorporate blockchain for enforcing contracts without intermediaries, fostering a more humane and efficient approach to conflict resolution amid rising concerns over government overreach and centralized control.
